Terms of Service

These Terms of Service ("Terms") govern your use of metcalfmarineexhaust.com (the "Site") and any purchase, quote request, or custom fabrication order placed with Metcalf Marine Exhaust, Inc. ("MMX," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms.

Products and Custom Fabrication

MMX sells in-stock marine exhaust parts and hardware through the Site, and provides custom fabrication services — including exhaust systems, risers, elbows, insulation, and related components — built from customer drawings, samples, or specifications.

Custom fabrication work is quoted individually based on vessel, engine, and application details. Quotes are estimates and are not binding until confirmed in writing. Lead times, pricing, and specifications for custom work will be provided at the time of quote and may vary based on materials, complexity, and shop schedule.

Orders and Payment

In-stock catalog items are purchased through our online store, processed by Snipcart and our payment processor. Prices are listed in U.S. dollars and are subject to change without notice. We reserve the right to refuse or cancel any order, including for pricing errors, suspected fraud, or product unavailability.

Custom fabrication orders may require a deposit or full payment in advance, as specified in your individual quote.

Shipping and Delivery

Catalog items ship from Fort Lauderdale, Florida. Shipping costs and estimated delivery times will be provided at checkout or in your quote. MMX is not responsible for delays caused by carriers, customs, or events outside our reasonable control.

Returns and Warranty

In-stock hardware (hose, clamps, sleeves, and similar items) may be returned unused and in original condition within 30 days of delivery; contact us before returning any item. Custom-fabricated parts, built to your vessel or specification, are generally non-returnable except in the case of a manufacturing defect.

MMX stands behind the quality of its fabrication and welding. Any warranty terms specific to a custom order will be stated in that order's quote or invoice. Absent a specific written warranty, products are provided without additional express warranties beyond those required by law.

Installation

Unless installation is expressly included in your order, parts and systems are supplied for installation by a qualified marine technician or yard. MMX is not responsible for damage or failure resulting from improper installation by a third party.

Limitation of Liability

To the fullest extent permitted by law, MMX's liability for any claim arising from a product or service is limited to the amount paid for that product or service. MMX is not liable for indirect, incidental, or consequential damages, including loss of vessel use, arising from products or services provided.

Intellectual Property

All content on the Site — including text, images, and design — is the property of MMX or its licensors and may not be copied or used without permission.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Broward County, Florida.

Changes to These Terms

We may update these Terms from time to time. The "Effective date" above reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the updated Terms.
